These are the terms and conditions on which we supply products to you. Please read these carefully before you submit your order to us.
Formation of Contract
Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us. If we are unable to accept your order, we will inform you of this and will not charge you for the product. We will assign an order number to your order and tell you what it is when we accept your order.
The images of products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device's display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images. If we are making the product to measurements you have given us, you are responsible for ensuring that these measurements are correct.
We deliver across mainland UK, Northern Ireland, Scottish Highlands, Isle of Man, Guernsey and Jersey as well as to countries within the European Union.
Deliveries within mainland UK (excluding Scottish Highlands).
We endeavour to create and deliver your personalised My Tasty Cookbook within 6 working days, however during peak seasons we may experience delayed delivery due to circumstances outside of our control. Should there be any changes to the delivery due to high volumes of orders, we will update our delivery details in the cart and on your order confirmation to advise of these changes.
Deliveries to Northern Ireland, Scottish Highlands, Isle of Man, Guernsey, Jersey and within European Union countries.
We endeavour to create and deliver your personalised My Tasty Cookbook within 10 working days, however during peak seasons we may experience delayed delivery due to circumstances outside of our control. Once your My Tasty Cookbook order has been created and quality checked, we will dispatch your order using the most appropriate delivery method required to ensure delivery within the specified timescale.
Your Rights to Cancel if you are a Consumer (personal/non business)
As a consumer then for most products bought online you have a legal right to change your mind and receive a refund. However, the right of consumers to change their mind does not apply in respect of:
- products which are ‘bespoke’ i.e. designed and manufactured to your specific requirements such that we could not resell them to anyone other than you;
If you have ordered a personalised item, as detailed above, there is no automatic right to cancel or eligibility for a refund. However, if you are unhappy with your order, please contact us and we will investigate your query. Please note each order will be managed on an individual basis and there is no obligation for us to process a refund unless the item or order is defective or faulty.
Price and Payment
Payment will be taken in Sterling as soon as you have completed the payment process. The price of the product (which includes VAT where applicable) will be the price indicated on the cart when you select "Pay Now".
We accept most recognised card payments and PayPal payments, but we do not accept eCheques. These payments are processed via Realex Global Payments. All payments are taken in sterling.
Loss or Damage if you are a Consumer (personal/non business)
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products and for defective products under the Consumer Protection Act 1987. If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.
As a consumer we only supply the products to you for domestic and private use. If you use the products for any commercial, business or re-sale purpose our liability to you will be limited.
You confirm that you own or have permission to use any text you provide to us in order to provide you with products, and that you grant us the right to display, modify, print, transmit, distribute or delete the text provided in order to provide you with products.
Nobody else has any rights under this contract. This contract is between you and us.
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date
These terms are governed by the laws of England and Wales.
